This page contains both the Terms of Use and the Privacy Policy for the Growing Up Deaf Summit. Please read both carefully.
The Growing Up Deaf Summit (the “Summit”) and its website at growingupdeaf.com (the “Site”) are owned and operated by Krispahlyn Daria, a sole proprietorship operating under the laws of Ontario, Canada (“Company,” “we,” “us,” or “our”). The terms “you” or “your” refer to any individual who accesses our Site or registers for, purchases, or accesses any of our services, products, and free or paid offerings, including the Summit and the All-Access Pass (collectively, “Offering(s)”).
These Terms of Use and this Privacy Policy are legally binding. By using our Site, by registering for the Summit, or by clicking to accept or agree when the option is made available to you, you expressly agree to be bound by and to abide by both, whether or not you have read them. If you do not agree, you must not access or use our Site or Offerings.
Terms of Use
General Provisions
You must be at least 16 years old to use our Site. The Growing Up Deaf Summit is created for hearing parents, caregivers, and adults supporting deaf and hard-of-hearing children. While our content is about children, our Offerings are directed to adults, and we do not knowingly collect, use, or disclose personal information about children.
Use of this Site is at your own risk. We host our Site on a reputable platform and take commercially reasonable efforts to maintain it, but we make no representations or warranties as to your individual safety or use of the Site. We reserve the right to update and change these Terms at any time and will update the “Last Updated” date at the top of this page accordingly.
While we aim to keep this Site current, we cannot guarantee that all content is entirely accurate, complete, or up to date. We reserve the right at any time to modify or discontinue, in whole or in part, any Offering or any prices for any Offering, without notice. We are not liable to you or any third party for any modification, price change, suspension, or discontinuation of any Offering.
If you wish to have any of your personal information or your access to our Site removed, you may email us at summit@krisdaria.com and we will make reasonable efforts to do so.
The Summit and Access
The Growing Up Deaf Summit is a virtual event featuring pre-recorded presentations and live sessions.
Free access. Registered attendees may watch each day’s presentations during that day’s free viewing window. Each day’s presentations are released at 9:00 AM EST and remain available for 48 hours, expiring at 9:00 AM EST. Times are always EST.
All-Access Pass (AAP). The All-Access Pass is a paid upgrade that unlocks lifetime replay access to the Summit presentations plus a curated resource bundle. For the purposes of these Terms, “lifetime” means for as long as we continue to operate and maintain the All-Access Pass library. If we discontinue the program, we will make reasonable efforts to provide notice.
Lineup and schedule subject to change. The presenter lineup, session schedule, and resource bundle are subject to change. We do not guarantee that any specific presenter, session, or resource will appear or remain available, and any such change is not grounds for a refund.
Registration, Purchase, and Consent
When you register for the Summit or purchase or opt into any Offering, you are given reasonable notice that these Terms exist. By doing so, you agree to abide by these Terms, confirm you are aware of the disclaimers below, and acknowledge and agree to our Privacy Policy.
By purchasing or accessing any paid Offering, you warrant that you are at least 18 years old or the applicable age of majority in your jurisdiction. Purchasing or accessing a paid Offering as a minor is a violation of these Terms, and we reserve the right to terminate your access if it is discovered you are a minor.
Intellectual Property and Ownership of Rights
Our Intellectual Property
All content, resources, materials, images, text, designs, graphics, page layouts, icons, videos, logos, taglines, trademarks (whether common law or registered), copyright, and service marks (“Intellectual Property”) on our Site, in any Offering, or posted on our social media is owned by and is the property of Krispahlyn Daria, unless attributed otherwise. It is a violation of law to use any of our Intellectual Property, in whole or in part, or to modify any of our materials, and we may seek financial penalties (damages) and/or an injunction to make us whole.
You may not, under any circumstances, reproduce, copy, modify, sell, republish, or distribute any part of our Site, Offerings, or related materials, or claim any of our Intellectual Property as your own, even with attribution, without our prior written consent. If you wish to use or publish any of our content, you must first request permission by email at summit@krisdaria.com.
Presenter Content
Each presenter retains ownership of their own presentation and the resources they contribute. Presenters grant us a license to host, stream, replay, and otherwise make their presentations and contributed resources available as part of the Summit and the All-Access Pass. Presenter views, opinions, and experiences are their own and do not necessarily reflect ours.
Limited License to Attendees
When you register for the Summit or purchase the All-Access Pass, you receive a limited, non-transferable, non-exclusive, revocable, royalty-free license to access the presentations and materials for your personal, non-commercial use only. You do not obtain any ownership interest in the materials, and all copyrights remain with us or with the respective presenter.
You may not record, screen-capture, download (except where a resource is expressly provided to you for download), copy, reproduce, sell, share, redistribute, or publicly display any presentation, resource, or other material, including sharing with any third party, team member, or family member who is not registered. If you exceed the scope of this license, you have committed infringement that materially harms us or a presenter, and we reserve the right to seek damages and/or an injunction.
Violations and Indemnity
We take violations and infringement of Intellectual Property rights seriously and reserve the right to take whatever legal steps are necessary to protect those rights. You agree to indemnify, defend, and hold us harmless for any and all damages, costs, and expenses, including legal fees, arising from your misuse of our Intellectual Property and our enforcement of our rights.
Media Release
By registering for or purchasing any Offering, you grant us a commercial license to use any image, including any containing your likeness, that you submit to us, whether voluntarily or by default (such as a profile picture on a social media platform), for our future business use. You must own the copyright to any image you submit. We are not obligated to notify you of our use of any such image.
Fees and Refunds
Fees
Fees are as listed on our Site and are in US dollars (USD). The All-Access Pass is a one-time payment. We reserve the right to change our fees at any time without notice.
No Refunds on the All-Access Pass
Due to the digital and time-sensitive nature of the All-Access Pass and its instant-access bonuses, all All-Access Pass sales are final. Strictly no refunds will be issued, and the Company does not offer any money-back guarantees. If you experience technical issues that prevent access, we will do our best to resolve them, but purchases are non-refundable.
Chargebacks
You agree to make every attempt to contact us to resolve any issue prior to attempting a chargeback with your financial institution or any third-party payment processor we use. By initiating a chargeback dispute, you expressly agree to forfeit any and all bonuses, affiliate bonuses, or other materials or resources provided to you. We reserve the right to present proof of your access to the Offering and your acceptance of these Terms to any third party investigating the dispute.
Affiliate, Presenter, and Promoter Program
We operate an affiliate program through Thrivecart that allows presenters and approved promoters to earn a commission on All-Access Pass sales referred through their unique affiliate link. Participation is governed by a separate Presenter Agreement or Promoter agreement, as applicable, which sets out commission rates, payment terms, and promotional requirements.
We may use affiliate links to promote certain Offerings. We disclaim any and all liability arising from your purchase through any affiliate link, including the delivery, quality, and safety of any purchased product or service. You accept express liability for any and all consequences of clicking affiliate links, and you agree it is your obligation to read the terms and conditions of any affiliate site, Offering, or product.
Security and Conduct
Account Security
If at any time you are required to create a username and password to access any Offering, it is your responsibility to protect them from theft or unauthorized use. We do not store whole credit card numbers or payment information; these are processed through our third-party processor. If you become aware that your credentials have been compromised, notify us immediately at summit@krisdaria.com.
Use of Third-Party Applications
To run our Site and provide our Offerings, we use a number of third-party applications, including for hosting, payment processing, email delivery, analytics, and live sessions. It is your responsibility to review the terms of use for any such application. If you do not agree with them, please discontinue use of our Site and Offerings immediately.
Your Communications
By submitting a comment, photo, video, or other material to our Site or any platform we use to provide an Offering, you grant us a non-revocable, commercial license to re-publish your submission, in whole or in part, unless you expressly state that we may not. Any communication made through our contact forms, email, or related pages is not held privileged or confidential and may be subject to viewing or distribution by third parties. You agree not to submit any content that is illegal, libelous, maliciously false, obscene, abusive, or otherwise harmful or inappropriate. We reserve the right, in our sole discretion, to block your access as a result of any such behaviour.
Prohibited Behaviour
By using our Site, you agree not to misuse or tamper with it, including by hacking or introducing viruses, trojans, worms, logic bombs, or other technologically harmful material. We will report any such breach or activity we deem harmful to the relevant law enforcement authorities. You agree to indemnify, defend, and hold us harmless from any and all third-party claims, liability, damages, or costs arising from your misuse of our Site or breach of these Terms.
Disclaimers
Educational and Informational Use Only
The Growing Up Deaf Summit and all related content, presentations, and resources are provided for educational and informational purposes only. They are not medical, audiological, speech-language, psychological, developmental, legal, or financial advice, and they are not a substitute for the advice of a qualified professional who knows you and your child. The Summit does not tell you what communication approach, technology, therapy, or path to choose for your child. It shares lived experience, perspectives, and resources so that you can make informed decisions for your own family. Always seek the guidance of appropriate, qualified professionals regarding your child’s health, education, and development. Reliance on any information provided through the Summit is solely at your own risk.
Assumption of Risk
By accessing our Site and Offerings, whether paid or unpaid, you assume all risk of your access and any subsequent actions you choose to take as a result of the information or educational materials provided to you.
Warranties Disclaimer
We make no warranties as to our Site, the Offerings, or any related materials. You agree that our Site and all Offerings are provided “as is” and without warranty of any kind, either express or implied. To the fullest extent permissible by applicable law, we expressly disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or any Offering will be functional, uninterrupted, correct, complete, or error-free, that defects will be corrected, or that any part is free of viruses or other harmful components.
No Guarantees
While we may reference certain results, outcomes, or situations, you understand and acknowledge that we make no guarantee as to the accuracy of any third-party statements or the likelihood of any particular outcome for you.
General Disclaimer
To the fullest extent permitted by law, we expressly exclude any liability for any direct, indirect, or consequential loss or damage incurred by you or others in connection with our Site or any Offering, including any liability for accidents, delays, injuries, harm, loss, damage, lost profits, personal or business interruptions, misapplication of information, or physical, mental, emotional, or spiritual injury or harm, whether caused by negligence, breach of contract, or otherwise, and whether foreseeable or unforeseeable. We are not medical, audiological, legal, financial, or other professionals acting in a professional capacity during the course of this Offering.
Earnings Disclaimer
You agree that you understand individual outcomes will vary. Case studies or testimonials are not indicative of typical results, including for any affiliate, presenter, or promoter earnings. Each individual approaches our Offerings with different backgrounds, resources, motivation, and other factors outside of our control. We cannot guarantee your success or financial gain.
Third-Party Disclaimer and Contributors
You acknowledge and agree that we are not liable for any defamatory, offensive, or illegal conduct of any other participant, presenter, or user, including you. Content provided by presenters and other third-party contributors reflects their own opinions and experiences. While we make our best effort to ensure our presenters are qualified and reflect our values, we make no guarantees of quality or accuracy and are not liable for any presenter’s or contributor’s content or opinions.
Technology Disclaimer
We make reasonable efforts to provide reliable technology, software, and platforms from which to access our Offerings. In the event of a technological failure, you accept that we are not responsible or liable for that failure or any resulting damages. While we will make reasonable efforts to support you, some technological issues are outside our control and may require you to access support from a third-party provider.
Indemnification, Limitation of Liability, and Release of Claims
You agree at all times to indemnify and hold harmless our Company, as well as our affiliates, agents, contractors, volunteers, successors, and assigns (collectively, “Released Parties”), from and against any and all claims, causes of action, damages, liabilities, costs, and expenses, including legal fees, arising out of or related to your use of our Site, Offerings, or related communications, including any consequences from technological failures such as payment processor errors. You further waive any legal recourse against the Released Parties for any damages, costs, losses, or expenses you may incur as a result of your use of the Site or any Offering. This release is binding on your heirs, executors, and anyone who may bring a legal action on your behalf.
We will not be held responsible or liable in any way for the information, products, or materials that you request or receive through or in relation to our Site or any Offering. We do not assume liability for any third-party conduct, accidents, delays, harm, or other negative outcomes as a result of your access to our Site and Offerings.
Dispute Resolution
If a dispute arises between you and us, you agree to first attempt to resolve it informally by contacting us at summit@krisdaria.com. If we are unable to resolve it through good-faith discussion, both parties agree to make a reasonable attempt to resolve the dispute through mediation before pursuing any other legal remedy.
Termination
If at any time we believe you have violated these Terms, we may immediately terminate your use of our Site, access to Offerings, and any related communications, as we deem appropriate and in our sole discretion. We may block or revoke your access at any time without notice, and if necessary, block your IP address from further visits to our Site.
Privacy Policy
We respect your privacy. This Privacy Policy explains how we collect, use, share, and protect the personal information you provide when you access our Site, register for the Summit, purchase the All-Access Pass, or engage with us, as well as your rights to the information we collect.
By accepting this Privacy Policy, you are specifically consenting to our collection of the data described below, to our use and processing of that data, and to our sharing of the data with third-party processors as needed for our legitimate business interests.
Information We Collect
Personal Data: Information that can be used to identify you, including your name, email address, billing address, telephone number, and demographic information such as your age or location. You provide this voluntarily, for example when you register for the Summit, purchase the All-Access Pass, sign up for our email list, or contact us. Your decision to disclose this data is voluntary, but refusing may prevent you from accessing certain Offerings.
Derivative Data: Information our servers automatically collect when you access our Site, such as your IP address, browser type, the dates and times you access our Site, and the pages you view. This may also include data collected by third-party analytics and advertising providers through cookies, log data, or web beacons. Derivative data generally does not identify a specific individual.
Financial Data: Data related to your payment method, such as credit card or bank details, collected to allow you to purchase the All-Access Pass. We store limited financial data. Most financial data is transferred to our payment processor, Thrivecart, and you should review Thrivecart’s privacy policy to understand how they use and protect your financial data.
Social Networking Data: We may access personal information from social networking sites and apps, including Instagram, Facebook, LinkedIn, YouTube, and others, which may include your name, username, location, email, profile picture, and other public information. To limit this, change your privacy settings on the relevant platform.
Device Data: If you use our Site via a mobile device, we may collect information about your device, including device ID, model, manufacturer, and location information.
How We Collect Your Information
We collect information you voluntarily provide when you register, purchase, opt into a presenter’s offer, submit a form, or contact us. We also collect information automatically from your browser or device as described above, using cookies and similar technologies.
Grounds for Using and Processing Your Data
We collect, use, and process your information on the following grounds:
- Legitimate business interests: including communicating with you, delivering and improving our Offerings and Site, and providing the information or products you have requested.
- Performance of a contract: to enter into and perform our obligations to you, such as delivering the All-Access Pass.
- Consent: based on the consent you provide. You may withdraw your consent at any time, though doing so may affect your ability to use our Site or Offerings.
- Legal obligations: to comply with applicable law.
How We Use Your Information
We may use the information we collect to: create and administer your registration or account; deliver the Offerings you purchase; correspond with you; process payments; send you Summit updates, newsletters, and offers we think will interest you; request feedback; resolve disputes and troubleshoot problems; compile anonymous statistical data; prevent fraud; assist law enforcement as necessary; and analyze trends to improve our Site and Offerings.
Presenter Bonus Offers and Email Sharing
We want to be clear about how your email address is handled in relation to our presenters.
Registering for the Summit does not share your email address with any presenter. When you register for the free Growing Up Deaf Summit, we do not give, sell, or share your email address with any of our presenters. Your registration stays with us.
Opting into a presenter’s bonus offer does share your email with that presenter. As part of the Summit, individual presenters may offer their own free resource, freebie, or bonus contribution. If you choose to opt into one of those offers, you are signing up for that presenter’s email list. Your name and email address will be shared with and managed by that presenter, and you will become their email subscriber. That presenter’s own privacy policy and email practices will apply. We do not control how each presenter uses or stores that information. If you later wish to unsubscribe from a presenter’s list, you will need to do so directly with that presenter, typically using the unsubscribe link in their emails.
Why and With Whom We Disclose Your Information
We will not sell your personal information. We may share your data with third parties in the following situations:
- Third-party processing: with providers who assist us with hosting, payment processing, email delivery, analytics, live sessions, communications, and customer service. We do not authorize them to use your personal information except in connection with providing us their services.
- By law: as required by law or legal process, or as necessary to protect the rights, property, and safety of others, including to prevent fraud.
- To protect our business: to investigate and remedy violations of our rights or policies, obtain insurance or legal advice, manage risk, or defend against legal claims.
- Business transfers: in the event of a merger, acquisition, sale, or similar transaction, your data may be transferred as a business asset. You acknowledge that such transfers may occur.
- Advertisers: we may use third-party advertising partners, including Meta (Facebook and Instagram), to promote the Summit. If and when we run such advertising, these partners may use pixels, cookies, or similar technologies to measure ad performance and show you relevant ads on their platforms based on your visit to our Site. You can review Meta’s privacy practices and opt out of interest-based ads through your Meta account settings.
- Live sessions: if you join a live Summit session, other participants may see your name and any messages you choose to share in that session.
Tracking Technologies
Log files: Like most websites, our hosting service logs visitor information, including IP address, browser type, internet service provider, date and time stamp, and referring pages. This is used to analyze trends and administer the Site and is generally not linked to personally identifiable information.
Cookies: We use cookies, which are small text files sent to us by your browser, to authenticate your session, remember your preferences, support security, measure performance, support advertising, and analyze how our Site is used. We may use any or all of the following:
- Essential cookies that help us run our Site and deliver your access.
- Functionality cookies that remember your preferences from earlier visits.
- Affiliate cookies that attribute an All-Access Pass purchase to the presenter or promoter who referred you.
- Advertising cookies that, if and when we run ads, help our advertising partners show you relevant ads on other platforms.
Most browsers accept cookies by default. You can disable cookies through your browser settings, though this may affect your ability to use or purchase from our Site. By continuing to use our Site without disabling cookies, you consent to our use of cookies in accordance with this Policy.
Pixel tags: We may use pixel tags, which are small graphic files that help us and our advertising partners (such as Meta) monitor use of our Site, measure advertising, and display relevant ads. These tags may collect your IP address and browser type.
Do Not Track: At this time, we do not respond to automated browser “Do Not Track” signals.
Website Analytics
We use Google Analytics to understand how visitors use our Site, determine the popularity of content, and improve our Offerings. Google Analytics may use cookies or other tracking technologies. You can opt out by installing the Google Analytics Opt-out Browser Add-on, and you can review Google’s privacy policy at policies.google.com/privacy.
Third-Party Tools and Service Providers
To run the Growing Up Deaf Summit, we rely on the following third-party tools, each of which may collect, process, or store certain information in accordance with their own privacy policies:
- HTMLpub: website hosting for our Site and registration pages.
- Klaviyo: email marketing, list management, and delivery.
- Thrivecart: checkout, payment processing, and affiliate tracking for the All-Access Pass.
- Google Analytics: website analytics and usage reporting.
- Zoom: delivery of our live sessions, including the live calls and live ASL practice sessions. When you join a live session, Zoom may collect your name, email, IP address, and other technical information, and sessions may be recorded for replay and for inclusion in the All-Access Pass.
We encourage you to review the privacy policies of these providers. We are not responsible for their privacy practices.
Email Policies
We are committed to keeping your email address confidential. We do not sell, rent, or lease our subscriber lists, and we will not disclose your email address to any third party except as expressly set out in this Privacy Policy. We use Klaviyo to manage and deliver our emails. In compliance with Canada’s Anti-Spam Legislation (CASL), all emails we send will clearly state who they are from, provide clear contact information, and contain an unsubscribe link so you can opt out of further communication. Processing Your Information
For the most part, we do not process your information in-house; we transmit it to third-party processors. For example, when Thrivecart takes your payment information, it processes your payment and remits the funds to us. From time to time we may process your data internally to administer and improve our Site and Offerings, fulfill our contracts, keep records, comply with legal obligations, and protect the rights and interests of our Company, our customers, and third parties.
International Data
Our Site and several of our service providers store data on servers located in the United States and elsewhere. If you reside outside those locations, your data will be transferred internationally and stored on those servers. Privacy laws in those jurisdictions may differ from those where you live. We take all reasonable steps to ensure your data is treated securely and in accordance with this Privacy Policy. The transmission of data over the internet is never completely secure, and your transmission of data to us is at your own risk.
Data Retention
We retain personal data only as long as is needed to conduct our legitimate business purposes, comply with our legal obligations, or until you ask us to delete it. Data we no longer need will be permanently deleted. We cannot control the retention policies of third parties; if you wish to have a third party delete your data, you will need to contact them directly. You may request a list of all third parties to whom we have transmitted your data.
Security of Your Information
We take all reasonable steps to protect your personal data, including using recognized secure payment systems and transmitting information securely. However, no security measure is foolproof, and no method of data transmission can be guaranteed against interception or misuse. We cannot guarantee complete security of any information you transmit to us. In the unlikely event of a known breach that may expose you to serious risk, we will notify affected individuals via email no later than 72 hours after we become aware of it, and report the incident to any required data protection authority.
Children
This Site is not designed for use by children under age 16, and we do not knowingly solicit personal data from anyone under age 16. If you are under 16, do not access or use our Site. If you become aware that we have collected data from anyone under 16, please contact us at summit@krisdaria.com so we may delete it.
Sensitive Data
We request that you do not submit any sensitive data to us, including your social insurance number, health data, genetic data, or information related to your ethnic origin, religious beliefs, or criminal history. If you do send us this information, then by doing so you are consenting to our use, storage, and processing of it in accordance with this Policy.
Your Rights
Under Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable laws, you have certain rights with respect to your personal data. We may charge a reasonable fee for certain actions, and we reserve the right to verify your identity before taking action. After we verify your identity, you have the right to:
- Update or change any information you have provided to us;
- Confirm what data we hold about you and for what purposes;
- Change or withdraw your consent to our use of your information;
- Request a digital copy of the data we hold about you;
- Request that we transfer your data to another organization in a commonly used, machine-readable format, unless doing so would cause us undue burden;
- Request that we delete the data we hold about you, subject to legal exceptions;
- Opt out of receiving future email correspondence from us;
- Opt out of having your personal information used for marketing purposes; and
- In certain situations, restrict the processing of your data.

Complaints
If you have a concern about how we handle your personal information, please contact us first at summit@krisdaria.com. If we are unable to resolve your concern, you have the right to file a complaint with the Office of the Privacy Commissioner of Canada (OPC). If you are a resident of the European Union or the United Kingdom, you have the right to complain to a supervisory authority in the jurisdiction where you live.
California Privacy Rights
If you reside in California, you have the right to obtain from us, once per year and free of charge, information regarding what information we disclose to third-party marketers. We do not sell your personal data. If you are a California resident under 18, you have the right to request that we remove any data you have publicly posted on our Site. General Provisions
Changes to This Agreement
We reserve the right to update and change these Terms and this Privacy Policy at any time, and will make our best effort to update the “Last Updated” date at the top of this page. By continuing to use our Site, you accept all changes. We encourage you to review this page each time you access our Site.
Severability
If any part of these Terms or this Privacy Policy is deemed unlawful or unenforceable, all other provisions will remain in full force and effect.
Entire Agreement
These Terms of Use, together with this Privacy Policy, constitute the entire agreement between you and us relating to your use of the Site and any Offering.
Governing Law and Jurisdiction
These Terms and this Privacy Policy are governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising directly or indirectly from this agreement will be submitted to and heard exclusively in the courts of the Province of Ontario.
